Court discharges, acquits 91 IMN members.

Justice Hajaratu Gwada of a Kaduna High Court on Friday discharged and acquitted 91 members of the Islamic Movement in Nigeria (IMN) also known as Shiites who has been in prison since 2015. Addressing newsmen shortly after the release of the IMN members, their counsel, Barrister Maxwell Kyon said his clients were charged of culpable homicide punishable by death, criminal conspiracy and disturbance of peace.

Barrister Kyon however said the state failed to prove their case beyond reasonable doubt, hence he filed a no case submission before Justice Gwada, and the court was able to determine that the state was unable to prove their case against the defendants in the charges leveled against them. He lamented that it was quite unfortunate for the system to hold individual in custody for no case for that long, stressing that some of them lost their children, wives, admission in tertiary institution while in custody.

He said Kaduna state must take responsibility of rehabilitating his clients for keeping them in prison for four years.

The government should engage with us and come out with a figure as compensation for those whose four years in detention at the Correctional Centre has been wasted.

The government made those people to be arrested and remanded in prison. We want government to take responsibility for the incarceration of these people for four years. Many lost their jobs, some lost admissions in tertiary institutions and I know of one whose wife left while he was in prison,” he said.

Abba Kyari vs Monguno: ‘Buhari is dead, El-Rufai, Sultan of Sokoto, recruited Jubril Al-Sudan’ – Nnamdi Kanu.

Nnamdi Kanu, leader of the Indigenous People of Biafra, IPOB, on Thursday insisted that President Muhammadu Buhari was dead and buried in a shallow grave in Saudi Arabia.”
Kanu said the claim by the National Security Adviser, NSA, Babangana Monguno’s claim that Buhari’s Chief of Staff, Abba Kyari was overriding the president’s decision was a testament to his allegation.
In a statement he personally signed, Kanu insisted that Kyari was controlling Nigeria as the current leader was an impostor.
The IPOB leader alleged that Kyari conspired with Kaduna State Governor, Nasir El-Rufai, Mamman Daura, Lawal Daura, Monguno, Sultan of Sokoto and the Chief of Army Staff, Tukur Buratai to recruit Jubril Al-Sudani who replaced Buhari.
According to Kanu: “Those Nigerians who out of a
combination of laziness, ignorance, envy, stupidity,
cowardice, timidity and curse, challenged my irrefutable assertion that Abba Kyari and not the late Buhari is the unelected president of Nigeria, can now see and hear their own National Security Adviser (NSA) Babagana Monguno confirm what IPOB and every top level intelligence agency in the world have known for a long time.
“I know this revelation from Nigeria’s NSA will come as a shock to brainless and roundly hopeless unity begging one Nigerianists but the inescapable truth remains that IPOB is always right. When we say Buhari is dead and buried in a shallow grave in Saudi Arabia with Abba Kyari now in charge in Aso Rock as the ruler of Nigeria, that is the undeniable fact.
“It was Abba Kyari along with Garba Shehu, Gov. El-Rufai, Mamman Daura, Lawal Daura, Babagana Monguno, Sultan of Sokoto and Tukur Buratai that conspired to recruit Jubril Al- Sudani to replace Buhari. Today they have fallen out with each other, hence the infighting.”
The IPOB leader also claimed that Fulanis promised Bola Tinubu, National Leader of the All Progressives Congress, APC, presidency to buy his silence.
“Fulani Jihadists dangled the presidency in front of Bola Ahmed Tinubu and used it to buy Yoruba media silence on this greatest Fulani fraud of all time. Today every ethnic group in the damnable British colonial experiment called Nigeria is paying a price for it. Ignore IPOB at your peril.
“How can ordinary Chief of Staff override the orders of a living president and an erstwhile ruthless and
unconscionable dictator for that matter? Where are the brains of some people?
“The same “no-nonsense” military dictator touted by Yoruba media in 2015 is being overridden by a common civilian staff? Nigerians should use their brain for once! Nigerians, behold your real ruler, unelected President Abba Kyari,” he said.

Bandits Raid Madaka, Niger. Kidnap Many

Gunmen on Wednesday, invaded Madaka and neighbouring communities in the Rafi local government area of Niger state. The gunmen according to sources, stormed the communities on motorcycles at about 6:30am, shot sporadically into the air, forcing locals to flee their homes.
The latest attack is coming barely four days after a police Inspector attached to Bangi police division, Ibrahim Mitra Chibok was killed by bandits during exchange of fire.
According to source closed to the communities, over 100 heads of cattle were rustled and many villagers kidnapped in the operation. A source from the area said those kidnapped by the bandits, mostly middle men were being used as shields for their escape.
“The bandits are heading towards Allawa in Shiroro local government area. We cannot say if there is any casualty until after the situation has returned to normal” the source said. He also said that men of the Nigerian Air Force were swift in attending to the distress calls from the villagers because ” we can see their helicopters hovering in the air to get the bandits”.
Efforts to get the Chairman of the Rafi local government council, Alhaji Ismaila Isa Modibo for comment was unsuccessful as his telephone was switched off. However the Director General of the Niger State Emergency Management Agency, Alhaji Ahmed Ibrahim Inga when contacted on phone confirmed the incident. “We received the report some minutes ago but I don’t have the details yet” Inga said.

Kudos to Nigeria Police Force.

Though I have been preoccupied in recent times, I could not begin the week without commending the various units of the Nigeria Police Force who took the fight against crime and terror to the criminals’ forested hideouts last week. I find this to be a welcome development, given the growing insecurity ravaging different parts of the country. It is always my belief that security agencies don’t have to sit and wait for the criminals to attack first. Instead, they are to go after them in their hideouts and deal with them before they could unleash havoc on vulnerable communities and road users.

Although the relationship between the Force and the citizens they are supposed to protect has always been complicated, the reaction of many Nigerians to the news of the audacious raid seemed skeptical if not dismissive. Some were even asking “where are they 250 bodies”? But I am certain these same individuals will have believed the news had it been it was the other way, when police officers are the victims. Isn’t it insulting to mock those who’ve risked their lives to ensure others live and travel safely”? But that shows you the lack of trust between a lot of Nigerians and this important institution. Nonetheless, I remember when Nigerians were angry at the criminal killing of some of the Force finest men, who were members of the  IGP’s Intelligence Response Team, by soldiers in Taraba while they were conveying notorious kidnap kingpin Hamisu Wadume. It shows the relationship could improve with assurances, cooperation and good gesture from both sides. As they say, actions speak louder than words. So, rather than engage in bribery, extortion, and harassment of innocent citizens as displayed by rogue police officers, the Nigeria Police Force needs to reinvent itself in order to deal with the challenges posed by rising criminality in the country today. Nevertheless, it is good to commend the Force whenever it does something good, just like the way some are quick to criticise and condemn police officials whenever they do anything illegal.

Immunity clause hindering corruption war – Lawyers

CJN Justice Tanko Muhammad and Abubakar Malami, AGF

Lawyers have expressed divergent views on the concept of the immunity clause, which has been identified as a major hindrance to the speedy determination of corruption cases in Nigeria. The immunity clause is a legal provision for protecting some categories of public officers from any civil or criminal proceedings during their time in office.

How this provision became statically ingrained in the Nigerian legal system is surprising considering the high rate of impunity and abuse of rule of law by some political office holders. But legal historians say the concept originated from the English common law system, which Nigeria adopted from her colonial masters. Section 308 of the Nigerian Constitution 1999 made the elaborate provisions on immunity for public officers. It provides in sub-section (1) (a) “no civil or criminal proceedings shall be instituted or continued against a person to whom this section applies during his period of office;
“(b) a person to whom this section applies shall not be arrested or imprisoned during that period either in pursuance of the process of any court or otherwise; and

“(c) no process of any court requiring or compelling the appearance of a person to whom this section applies, shall be applied for or issued.”

“The section provides in sub-section (2) that the provisions of subsection (1) of this section shall not apply to civil proceedings against a person to whom this section applies in his official capacity or to civil or criminal proceedings in which such a person is only a nominal party. “(3) This section applies to a person holding the office of President or Vice-President, Governor or Deputy Governor; and the reference in this section to “period of office” is a reference to the period during which the person holding such office is required to perform the functions of the office.” There have been several instances where the immunity clause prevented civil and criminal cases from proceedings against some political officeholders. The cases of some governors have been suspended following their election as governors. Among them are Ahmadu Umar Fintiri (Adamawa), Bala Mohammed (Bauchi), who are facing criminal cases in court. However, the cases have been suspended owing to the governors now being covered by the immunity clause in Section 308 of the Nigerian Constitution. Fintiri, who was a former speaker of the state House of Assembly and acting governor, was facing a five-count charge bordering on bribery, and money laundering alongside Mayim Construction and Properties Ltd before Justice A.R. Mohammed of the Federal High Court, Abuja Division. He was alleged to have laundered state funds valued at N1.9bn through his Naira and Dollar bank accounts, and making payments for the purchase of landed properties in Abuja. He was alleged to have used N220m to acquire property during his time as acting governor for three months in 2014. The EFCC revisited the case of the former FCT Minister Bala Mohammed in April 2019 shortly before his inauguration as governor. The case was reassigned from Justice Abubakar Talba of the FCT High Court to Justice Yusuf Halilu of the same court. The EFCC alleged that Mohammed made a false statement that he acquired a house at No 2599 and 2600 Cadastral Zone AO4 Asokoro District Abuja and other houses in Abuja through mortgage facility from Aso Savings and Loan Bank Plc when he received them as gratification for performing his official duties. Before the 2019 allegations, the ex-minister was initially charged in December 2016 and May 10, 2017, on allegations of abuse of office, false declaration of assets and fraud to the tune of N864m. He was also accused of receiving N550m in bribes from Aso Savings and Loans Plc concerning properties in Abuja during his tenure in 2014. Also, petitions were sent against former governors who were still serving and the decision was that they can only be investigated not prosecuted pending the conclusion of their tenure. For instance, the EFCC was investigating former governor of Ekiti State, Ayo Fayose over allegations of collecting the sum of N1.3bn from the office of the National Security Adviser, Col Sambo Dasuki. He was only formally charged upon his handover in October 2018. Reacting, Prof Ernest Ojukwu (SAN) said the immunity clause is a temporary provision, which lapses at the end of the tenure of political office holders and they can face criminal and civil litigation for the infractions committed during their tenure. “The reason for the immunity provision is not to protect the individual but to protect the state governance from distractions such leaders may bring to governance if while in office they are subjected to criminal and civil proceedings,” he said. On his part, E.M.D. Umukoro Esq posits that the clause has its plus because it prevents unnecessary distractions for some political officeholders. “Unfortunately, the Nigerian politicians in their criminal ingenuity appear to see it as a protective cocoon and an avenue to loot the treasury dry using all manner of criminal creativity to cover their tracks,” he said. “As to the way it can be removed; it is only by amending the constitution. The process is for the National Assembly and the State Houses of Assembly to by 2/3 majority remove same and then is assented to.” Oluwatosin Ojaomo Esq said he has been advocating for the removal of the immunity clause from the constitution because it was inherited from the British who believe that the king can do no wrong. “My point remains that removal of the clause is not just enough because Nigeria has no constitution but military decree cloned in form of a constitution. The Nigerian people have no constitution made by them,” he said. “The immunity clause is a constitutional assault on the Nigerian people because immunity is a licence to impunity,” he added.

Police Inspector Killed, Two Officers Injured In Shootout With Bandits.

A Police Inspector, Ibrahim Chibok, has been killed during a shootout with bandits who attacked Muchiya Kaji village in Niger State.
The Police Public Relations Officer in Niger, Muhammad Abubakar, confirmed this in a statement on Monday.
He revealed that two other officers of the Niger State Police Command were injured during the incident which occurred on Sunday in Mariga Local Government Area of the state.
Abubakar said the slain and injured officers were part of joint police and military team who received a distress call that some armed men suspected to be cattle rustlers had stormed Muchiya Kaji village.
He noted that the team responded quickly and engaged them in a fierce gun battle, adding that three bandits were fatally wounded while the others abandoned the cattle and fled into the bush.
The command’s spokesman disclosed that one AK-47 rifle and a motorcycle were recovered as exhibits.
“Unfortunately, one Police Inspector, Ibrahim Mitra Chibok, attached to Niger State Police Command died during the encounter, two officers sustained gun wounds and are receiving treatment.
“The Police are on the trail of the armed bandits,” the statement said.
According to Abubakar, the slain police officer was part of the team that engaged bandits and cattle rustlers who invaded Dankolo Village in the same Mariga LGA on Friday last week.
He said the team recovered 13 cattle and fatally wounded three bandits who were later confirmed dead.
“The Niger State Police Command and the Force as a whole deeply regret the demise of the gallant inspector for paying the supreme price in fighting armed banditry in the state.
“The police command joins his friends and loved ones in commiserating with the deceased’s family over his demise. We pray that God Almighty should give them the fortitude to bear the irreparable loss,” the statement added.

I didn’t threaten Boko Haram leader~ Kogi state Governor Bello cries out .

Following the viral claim that Kogi state Governor Alhaji Yahaya Adoza Bello issued a strong warning to the leader of the Islamic sects Abubakar Shakau, the Governor through the Chief press secretary Mr Onogwu galaticus has come out publicly to debunk the rumour.
The Kogi state Governor didn’t not issue any statement to president Buhari and Boko Haram leader Abubakar Shakau, it is purely rumour of imagination, he said.
At the moment, we are tirelessly working to bring the dividends of Democracy to the good people of kogi state, by providing jobs, infrastructures and prevent our borders from external frowns of fortune. he stressed.
He however concluded that, with the current level of preparedness and determination on the path of the federal government, insecurities will be history in less than no time.

Court issues arrest warrant for ex-Customs boss, Dikko

A Federal High Court in Abuja on Monday issued a bench warrant for the arrest of former Comptroller General of the Nigeria Customs Service (NCS), Abdullahi Dikko.
Justice Ijeoma Ojukwu issued the warrant over Mr Dikko’s sustained failure to attend court to answer to a charge of fraud brought against him and two others by the Independent Corrupt Practices and Other Related Offences Commission (ICPC).
Dikko’s lawyer, Solomon Akuma, on the last adjourned date, promised to ensure his client’s presence in court.
Mr Akuma, however, presented a medical report on Monday, claiming Dikko was critically ill and hospitalised in London.
Justice Ojukwu noted that Dikko’s address, as shown on the medical report – 6, Amhed Musa Crescent Jabi, Abuja – did not support his lawyer’s claim that he was admitted in a London hospital.
The judge said that if Dikko was actually hospitalised in London, the prosecution should suspend effecting the arrest warrant, but if found to be otherwise, the prosecution should arrest Dikko and produce him in court on March 16, 2020, the next adjourned date for arraignment.
ICPC alleges in the charge marked FHC/ABJ/CR/21/2019
that Dikko and others induced the Managing Director of Cambial Limited, Yemi Obadeyi, to pay N1.1 billion (N1,100, 952,380.96) into the account of Capital Law Office as a refundable ‘completion security deposit’ for the purchase of 120 units of duplexes as residential accommodation for officers of the Nigeria Customs Service.
Others named in the charge as defendants are a former Assistant Comptroller-General of Customs in charge of Finance, Administration and Technical Services, Garba Makarfi; and Umar Hussaini, a lawyer and owner of Capital
Law firm.
ICPC alleges that Hussaini distributed the money into various other bank accounts and was rewarded with the sum of $3 million.

Planned Protest Against Service Chiefs Aimed At Embarrassing Buhari – Presidency

The Presidency has accused the opposition Peoples Democratic Party (PDP) of planning a protest for the removal of service chiefs over poor security on the country.

According to the Presidency, the protest is an effort is to embarrass President Muhammadu Buhari.
“The Presidency wishes to caution a section of the political class against misleading the public and inciting protests against the heads of military institutions.
“This has become necessary in view of received reports that about two thousand men and women have been hired to demonstrate against Nigeria’s service chiefs on Monday,” the statement which is signed by the senior special adviser to the President on Media and Publicity, Garba Shehu said.
Shehu in the statement added that “this imminent gathering is the latest in a series of demonstrations orchestrated by the opposition to embarrass the government of President Muhammadu Buhari.”
He added that PDP had earlier commenced a march from one embassy to the other in protest against the Buhari administration and the nation’s highest court of justice, the Supreme Court.
“They are keen to give the impression that Nigerians are in support of them as they take to the streets, and they will go to any length to promote this false narrative.”
Speaking concerning the recent incident in Maiduguri, Borno State, where a group of people were recorded booing President Buhari, Shehu said this is a part of PDP’s ‘elaborate scheme.’
“It is misleading, as some analysts have tried to do, to read this as the verdict against President Buhari, who emerged winner with 94 percent of the votes cast in the Presidential election in the state in February last year.”
Shehu, therefore, stressed that the people in the video were hired few all just to embarrass the President.

Panic as gunmen attack travellers near Kaduna train station.

There was confusion on Sunday night when suspected gunmen attacked travellers along Airport Link Road near Rigasa railway station in Kaduna State. The incident according to eye witnessed created panic among passengers who alighted from the train around 8:30 pm.

An eye witness at the motor park who simply identified himself as Isah told Daily Trust that they heard gun shots while passengers were on their way to their destinations. “Yes, it’s true that gunmen attacked travellers along Airport Link road again after they alighted from the train. There was a convoy that was almost caught in the fire which we suspected it to be a minister ‘s convoy but the convoy made an emergency u-turn and go through Rigasa town,” he said.

It was not clear which of the minister’s convoy was almost attacked because the incident happened at night.
But Isa said soldiers who were stationed around the railway station went after the attackers.

Contacted the State Police Command Public Relations Officer, ASP Muhammad Jalige didn’t answer his call and didn’t reply text sent to him on the issue. ‎It could be recalled that the Sunday attacked on travellers along that route made it the the third time gunmen lay siege on innocent travellers in less than a month.

President Buhari Is Breaking The Law – Falana.

Human rights lawyer, Femi Falana on Monday said President Muhammadu Buhari is running afoul of the law in his decision not to terminate the current crop of security Service Chiefs.
Mr Falana, who appeared onSunrise Daily, argued that the laws regulating military officers require the retirement of military officers who have served for 35 years or have reached the age of 60.
He added that a lawsuit would be filed this week in respect of the matter.
In an interview that lasted more than 20 minutes, Mr Falana also said President Buhari “must be prevailed upon” to acknowledge the possibility of “internal sabotage” within the military in the war against insurgency.
Responding to statements from the Presidency cautioning against public protests against the government, Mr Falana said such comments should be “embarrassing” to the President who, before he took the country’s reins, had led public demonstrations.

What Falana Actually Said

“Under the public service rule, under the harmonised rules for military officers in Nigeria and under Section 6 of the armed forces act, which empowers the President to make rules and regulations for the military, there is no provision for extension of tenure (for Service Chiefs) beyond the period stipulated by law. It has been done in the past, but that does not make it right. There is equality before the law, so you can’t extend the service of certain officers while you ask others to go after 35 years of service or the attainment of 60 years of age.
“To the best of my knowledge, a suit will be filed during the week, in respect of this matter.
“The President must be prevailed upon to appreciate that we may also be undergoing what you might describe as internal sabotage (in the fight against insurgency) by many members of the armed forces who simply feel since these are the people who can stop insurgency or terrorism, let them go ahead. Because the Chief of Army Staff himself has had an occasion to accuse members of the armed forces of not doing enough.
“The Service Chiefs are retiring officers who have served for 35 years or have reached the age of 60 – it is their fault not to appeal to the President for them to go or to resign.

On Caution Against Public Protests

“Is the Nigerian state telling us that a protest by 2,000 people cannot be managed? What on earth is going on? We have to recognise the right of Nigerians to protest for or against the government. And just last week in Abuja sponsored agents of the government staged a protest asking the government to expel Amnesty International from Nigeria. Even against me, the government had sponsored some elements to demonstrate in Abuja. I have evidence. If the government can mobilise support and get its agents to demonstrate in favour of its own policies; Nigerians must also be given the opportunity to demonstrate against policies of the government considered inimical to their interest.
“I want to believe that some of these statements oozing out of the Presidency are meant to embarrass the government, particularly President Muhammadu Buhari. Because the case of ANPP and Inspector General of Police decided by the Court of Appeal in December 2007 on the rights of Nigerians to demonstrate without police permit, without the fiat of the government, was handled for the former leaders of the ANPP, who are now in the APC, by my humble self, from the High Court to the Court of Appeal; and that is the law today.
“Following that judgement, the National Assembly in 2015 amended the Public Order Act by imposing a duty on the police to provide security for Nigerians who wish to demonstrate. That is the law today.
“Whenever I have had cause to lead a demonstration or participate in one, we have always written to the police for protection, not for permit. And I must confess, so far, I have not had any case where we have been told not to demonstrate. The only time, I think, was last year when Professor Soyinka and I were supposed to address a meeting and the police said it won’t take place; I said no, call the authorities, this is the right we have fought for and won. And in fairness to them, we were allowed to have the program.
“What is particularly embarrassing is that on the 20th of November 2014, the Presidential Candidate of the APC, General Muhammadu Buhari, now President Muhammadu Buhari, the then APC Chairman, Chief John Oyegun, two current Ministers, Dr. Sylvester Onu and Rotimi Amaechi, led others to demonstrate in Abuja against insecurity in the country, and they were more than 2,000. Heavens did not fall and heavens will not fall this time around.”
